Dreamtonics Account User Agreement

Welcome to register and use the account provided by Dreamtonics Co., Ltd (hereinafter referred to as “Dreamtonics Account”). Before you register and start using the Dreamtonics Account, please carefully read this Dreamtonics Account User Agreement (hereinafter referred to as “this Agreement”). This Agreement constitutes an agreement between you and Dreamtonics Co., Ltd (hereinafter referred to as “we” and “us”). By registering and using the Dreamtonics Account, you signify your acceptance of all the terms and conditions stated herein. If you do not agree with all or part of the terms of this Agreement, Dreamtonics Co., Ltd will not grant you the permission to use our account.

1 About Dreamtonics Account

The Dreamtonics Account serves as a user identifier that we utilize to deliver products and services to an end user. The ownership of the Dreamtonics Account belongs to us. We grant you the right to use the Dreamtonics Account only for the purposes specified in this Agreement, and this right is conditional upon your continuous compliance with all applicable laws as well as applicable contractual terms and conditions.

You can utilize your Dreamtonics Account to access the diverse services that we offer on our official website and within our products, and thus enjoy our services, which include but are not limited to membership benefits and other high-quality services.

2 Registration and Usage Rules of Dreamtonics Account

A. Registration

When registering for the Dreamtonics Account, you must have reached the age of 14 or the equivalent minimum age stipulated in the judicial jurisdiction where you are located. Additionally, you are required to meet the requirement of soundness of mind for full legal capacity as specified in the judicial jurisdiction where you are situated. If you do not meet the above conditions, you should read the terms of this Agreement and register and use the Dreamtonics Account under the supervision of your guardian. Meanwhile, we recommend that guardians keep an eye on and guide their children’s behavior when they use the Internet, mobile phones, and other devices.
You need to register a Dreamtonics Account by filling in your email address and password. Alternatively, you can use your Dreamtonics Account by binding it to a third-party user or platform account with which we cooperate.
You guarantee that all the information you submit during the registration process is genuine, accurate, legal, valid, and belongs to you. If the registration information you provide is inaccurate, untrue, or contains illegal or harmful information, we have the right to reject your registration.
After registration, if we have reasonable grounds to believe that the Dreamtonics Account you are using has been obtained through fraudulent means, with malicious intent, or for illegal purposes, we have the right to restrict, freeze, or terminate your use of the Dreamtonics Account without prior notice to you; you will be responsible for bearing the relevant legal responsibilities and losses.

B. Use and Trial Use

Your Dreamtonics Account acts as your credential for using our products. It is intended for your individual use only. The Dreamtonics Account will uniquely link to your product licenses. You should use the account name/email and password of your Dreamtonics Account, or alternatively, a third-party login method bound to your Dreamtonics Account, to access the products. You must handle these credentials with care and refrain from disclosing or sharing them with any third party. We will not be held responsible for any damages caused by the improper management of your Dreamtonics Account and password, improper usage practices, or any usage by a third party.
We offer certain products with a free trial period (hereinafter referred to as “Trialable Products”). You can access Trialable Products through your Dreamtonics Account without purchasing a license. Once the trial period expires, you can continue to use the Dreamtonics Account and the basic functions of the products (if available), but you will no longer be able to utilize the functions that were available during the trial period or those of the paid version.
The same Dreamtonics Account can only be logged in from one device simultaneously. Users are prohibited from logging in to the same Dreamtonics Account from multiple devices simultaneously.

C. Modification and Recovery of Dreamtonics Account

If you lose your device or forget your password, you can change your account password by requesting a confirmation email. If you need to retrieve your account information, you can provide the corresponding information to our support channels to initiate the Dreamtonics Account recovery process. The success of the recovery depends on the accuracy and completeness of the information you provide.
1. The proof of purchase for each product in your account.
2. The activation code (if applicable) for each product in your account.
If you own multiple Dreamtonics Accounts and have added a product license to the wrong account, you can provide the following information to apply for a transfer of the license from one account to another, provided that both accounts are owned by you. However, each product license can only be transferred once.
1. The email address associated with the account that currently holds the license.
2. The email address associated with your other account.
3. Your proof of purchase from Dreamtonics or one of our certified resellers.

D. Cancellation of Account

You can choose to cancel your Dreamtonics Account. After your account is canceled, you will still be accountable for your actions during the period when you were using our products prior to the cancellation. Please note that canceling your account means that all information, related products and services, virtual property, product and service trial rights, etc. associated with your Dreamtonics Account cannot be restored.

E. Prohibited Conduct

You are permitted to use the Dreamtonics Account within the scope defined in this Agreement. However, you must not engage in the following actions when using the Dreamtonics Account. Otherwise, you will be solely responsible for any liabilities arising therefrom, and we reserve the right to hold those who commit the following actions legally accountable:

Registering a Dreamtonics Account with malicious intent.
Giving, lending, leasing, transferring, or selling any Dreamtonics Account, or granting its usage to anyone other than the original applicant.
Taking any measures such as reverse engineering, reverse compilation, or disassembly that lead to the extraction of information like basic concepts, structure, algorithm, and source code of our products.
Attempting to bypass the copyright protection technology and technical restrictions of our products.
Falsifying information that may be used in our products.
Any action that infringes or may infringe on our copyrights or those of a third party.
Sending or creating harmful computer programs, etc.
Slandering or defaming us or a third party.
Any action that violates or may violate privacy rights.
Any action that goes against public order and good morals, or disclosing obscene documents, drawings, synthesized voices, etc. to others.
Interfering with the operation and use of our products.
Any other actions that violate or may violate the law.

3 Liabilities for Breach of Agreement

In the event that we discover or receive reports or complaints from others indicating that you have violated the provisions of this Agreement or relevant laws and regulations, we reserve the right to make independent judgments regarding this matter. If, based on our independent judgment, you are found to be in such a situation, we reserve the right to take necessary measures to promptly prevent the occurrence of your breach or to mitigate the effects of your breach. The measures include but are not limited to deleting any content uploaded by you that is the subject of a complaint, suspending or terminating your Dreamtonics Account, and monitoring your activities using your Dreamtonics Account. Depending on the severity of your breach, your right to use your Dreamtonics Account may be subject to warnings, restrictions, prohibitions, suspensions, cancellations, terminations, or other limitations or consequences, as determined by us in our sole discretion. To the extent permitted by applicable law, all losses that you may incur (including but not limited to the removal of files, products, related data, etc.) arising from and as a result of your breach shall be borne entirely by you, and we will not be liable to compensate you in any way.

The liabilities for breach of this Agreement will remain in effect even if you terminate your use of the Dreamtonics Account.

4 Applicable Law and Dispute Resolution

This Agreement shall be deemed to have been entered into in Japan, and any disputes arising under this Agreement shall be resolved in accordance with the laws of Japan. The user agrees that claims asserted in legal proceedings by either party against the other party shall be initiated and continued in the Tokyo District Court in Tokyo, Japan. If any provision of this Agreement is found to be unenforceable by a court or other adjudicatory body in any jurisdiction, such provision shall be enforced to the maximum extent permitted, and the remainder of this Agreement shall remain in full force and effect.
